Felony Assault with Device Similar to firearm – Not Guilty
Client was accused of assault and battery, threatening behavior using a device that appeared to be a firearm
Synopsis: Attorney Pine’s client was in an 8-month relationship, where the two lived together. Following a breakup, the complainant accused our client of showing up at her work, entering the rear of her car and holding a gun at her head. The complainant stated that she was in fear for her life and once she was able to escape the suspect, while he was walking away from the scene, she took photographs of him. Police went to the suspect’s home and arrested him. During the search of his home officers seized a number of items and they retrieved surveillance from the location where the incident took place. The vehicle was processed for latent fingerprint activity as well as for DNA. With all of the evidence taken, only one item, a hat, was positive for the suspect’s DNA. Further, no firearm was ever recovered.
Attorney Pine’s client was charged in the Rhode Island Superior Court with:
Count 1 –Felony Assault Device Similar to a Firearm, in violation of RIGL § 11-5-2.1
Count 2 – Domestic Violence – Disorderly Conduct – 1st Offense, in violation of RIGL § 11-45-1(a) and 12-29-2(a)(4)
Attorney Pine represented the man at trial. He cross-examined the female complainant, highlighting inconsistencies in her details of the incident. He also examined many of the officers involved and was able to show the jury significant factual errors in the police investigation that weakened the credibility of the prosecution’s case. Attorney Pine in cross-examination of the complainant, asked her to try on the hat, believing it belonged to her, and it fit.
Based on these collected factors, Attorney Pine argued to the jury that the woman’s inconsistencies as well as the lack of evidence was simply not enough to justify a criminal conviction. After deliberating for less than an hour, the jury found the Defendant not guilty of all charges.
Mr. Pine saved me from false allegations, and almost a 3 year-long battle against the North Kingstown police, and (my) ex-girlfriend.

First Degree Murder – Not Guilty
Client was accused of the shooting death of a man during a botched robbery.
Synopsis: While sitting in a parked vehicle with 3 others, 2 suspects brandished firearms in an attempt to rob the passengers of their money and valuables. One of the suspect’s firearm discharged, striking and killing the victim, who was a rear passenger’s seat. The victim was rushed to Rhode Island Hospital, where he was declared deceased as a result of the gunshot wound.
Attorney Pine’s client was charged in the Rhode Island Superior Court with:
Count 1 – 1st Degree Murder, in violation of RIGL § 11-23-1
Counts 2-4 – First Degree Robbery, in violation of RIGL § 11-39-1(a)
Count 5 – Conspiracy, in violation of RIGL § 11-1-6
Count 6 – Discharge of a Firearm When Committing a Crime of Violence resulting in Death, in violation of RIGL § 11-47-3.2(b)(4)
Counts 7-8 – Discharge of a Firearm When Committing a Crime of Violence – No Injury resulting, in violation of RIGL § 11-47-3.2(b)(1)
Count 9 – Carrying a Pistol or Revolver Without a License or Permit, in violation of RIGL § 11-47-8(a)
Outcome: Attorney Pine represented the man at trial. During trial, he cross-examined the State’s witnesses, calling into light the questionable evidence from multiple cell phone extractions, surveillance and the fact that although surveillance showed 2 assailants, the prosecution only focused on 1. The other suspect was never investigated, arrested or charged. Following a 2-week trial, and the presentation of numerous witness testimony and multiple exhibits, after deliberation, the jury found Defendant not guilty of all charges.

Second Degree Child Molestation – Not Guilty
Substitute teacher was accused of engaging in sexual contact with a person 14 years of age or under
Synopsis: A well-respected substitute teacher was accused of having sexual contact (inappropriate touching) with one of his students. The accusation came as a late disclosure, 10 years after the incident(s) allegedly took place. Prior to these accusations, there were never any reports of inappropriate conduct during the time the client had been employed. At the time of the late disclosure, the alleged victim could not remember the name of the teacher but alleged that the memories followed her throughout her childhood. The student would eventually pick our client out of a photo line-up.
Attorney Pine’s client was charged in the Rhode Island Superior Court with:
Count 1-5 – Second Degree Child Molestation, in violation of RIGL § §1 1-3 7—8.3 and §1 1-37-84
Attorney Pine represented the man at trial. He skillfully cross-examined the female complainant, highlighting her delayed report, and inconsistent recollection of the incident(s). He also showcased the girl’s faulty and untrustworthy memory. Based on these collected factors, Attorney Pine argued to the jury that the woman’s word – at least in this case as well as the lack of evidence was simply not enough to justify a criminal conviction. After deliberation, the prosecution dismissed Counts 1 and 2 and the jury found the Defendant not guilty of all other charges.
