Stay safe and protect your rights on Super Bowl Sunday

Over the years, the Super Bowl has turned into an event that is not just for football fans. Many people who have little interest in the game host and attend Super Bowl parties. In fact, Super Bowl parties are such a big deal that Americans eat more on Super Bowl Sunday than on any other day except Thanksgiving, according to the U.S. Department of Agriculture.

Eating too much, while not healthy in the long term, is not dangerous. Drinking too much, however, can be very dangerous. If you are drinking at a Super Bowl party, it is best to designate a sober driver or call a cab if you cannot drive.

You should also be aware that there may be increased DUI/DWI patrols on Sunday and Monday. If you are pulled over by the police, think about whether you want to take the breathalyzer test. You may refuse the roadside breath test, but if you refuse the test at the police station, you could lose your driver's license for six months to a year. You may also be assessed fines and fees of over $1,000. Refusing the breath test has other penalties as well, but it does limit the evidence the police have in the criminal DUI case.

If you do take the test, the penalties will vary depending on the blood alcohol content (BAC) results. The minimum DUI penalties for a first offense include up to $1,000 in fees and fines, a license suspension from three months to a year and/or up to a year in jail, and additional penalties. A DUI conviction can affect your life for years.

You have the right to talk to a lawyer before you take the breath test, and this may be a good idea. An experienced criminal defense attorney can explain your rights and the consequences of refusing or taking the chemical test. They can also help you with any criminal matters that may arise such as:

  • Bail
  • Assault charges
  • Drug charges
  • Moving violations
